You understand that failure to completely and thoroughly read, comprehend and/or evaluate these Terms Shall not constitute a valid excuse for failing to comply with any of the obligations and/or conditions laid out in the subsequent clauses of these Terms.  You warrant that it shall be your sole responsibility to keep yourself updated as to the latest modifications or amendments to these Terms available on the Website.

 Website Services and License.

Pawan Enterprises, through the website, offers services for users like Publishing of operating system and system software, Web-page-designing, Writing, Modifying, Testing of computer program to meet the needs of particulars clients.  Provides software support and maintenance to the clients.   Upon your purchase we provides you a limited, revocable, non-exclusive, non-sub licensable, non-transferable license to use the services provided through the Website (hereinafter referred to as “License”).  This License shall subsist as long as you continue to make the subscription payments to maintain the validity of your webpage as per the payment applicable time to time.

Pawan Enterprises also provides service whereby Users may avail, Online Courses Plus multiple other learning Materials, the details of which are present on the website, and which are provided at the time of Registration.  You hereby agree not to communicate such teachings, learning materials, or other proprietary information acquired through the “Basic of Digital Marketing” series to any other person. 

 Competency to Contract

Access and/or use of the website is limited to persons who are legally competent to contract with us under the Indian contract Act of 1872.   If you have not attained the age of 18 years, then continued use of the website shall constitute a binding contract between your parent/legal guardian and us.  However, we reserve the right to terminate access/use of the website, delete or retain any information provided to us, and/or prohibit further access/use of the website.

If you wish to purchase any product or service made available through the Service (“Purchase”),  you may be asked to supply certain information relevant to your Purchase including without limitation, your credit card number, the expiration date of your credit card, such as your name , email address, mobile number and   for sometimes your address if required.

Payment (INR/USD ($) only)

You purchase any product, or order any service offered by us on the website, such purchase or order shall not be accepted until payment (INR/USD ($)) is received for the same from your end.   No electronic or other confirmation received at the time of placing such order shall constitute a valid acceptance of the purchase/order on our behalf.

Pawan Enterprises may, at it’s own sole discretion, without notice to you, discontinue modify the specifications, or alter the pricing of any of the products or services offered through the website, the website, without incurring any obligation towards you.

Pawan Enterprises has the right to amend its pricing policy from time to time.   Pawan Enterprises shall not be liable for any amounts due from you to the payment gateway.  Further, in case of refunds, we shall not be liable to refund the processing fee levied by the payment geteway.  And Pawan Enterprises also shall not be liable for any loss, damage, duplicate charge or any other additional amount resulting due to errors like unstable network connections, glitches, server latency before, during, or after the processing of a purchases transaction.

You understand and undertake that failure by you to make use of, or completely avail of, any products or services bought or subscribed to by you via the website. Does not excuse you from making timely payments, or relieve you of any payment obligations that are otherwise applicable and binding upon you.

Delivery Policy

All the Products which are being sold on our website are Digital.  Which means you will get the link to your email address alongwith User ID and Password.   Shipping is not applicable.

 Refunds/Cancellation

 Except when required by law, paid subscription fees are non-refundable.

In case of dissatisfaction from our services clients have the liberty to cancel their Digital Products or services and request a refund from us.  Our Policy for the cancellation and refund will be as follows :-

You must submit a Cancellation/refund request in writing to pawan@basicofdigitalmarketing.com

Cancellation will be considered only if the request is made within 7 (Seven) days after placing the order.

Such refund request must be made within 7 (Seven) days from the date of your purchase.

To complete your refund, we required order number or your registered email or your phone number to track your order details.

Whatever the processing fee applicable for Bank/Payment gateway to transfer the amount will be bear by the customer.

It will take 3-7 working days for the refund to be processed to the end customer from the date of written request for refund.

Ethical issue

We do not allow image uploads, video linking or files linking or the use of Pawan Enterprises pages, resources or assets on websites that are of the following nature :-

Pornographic, racist, hate defamatory/libelous, extreme violence or the promotion of violence/terrorism, self harm, narcotics, controlled substances or other products/services that present a risk to consumer safety, deceptive, misleading fraudulent or otherwise illegal activities.

Our Service may contain links  to third party websites or services that are not owned or controlled by Pawan Enterprises.   There is no control over and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services.  We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Pawan Enterprises shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third party websites or services that you visit.

Governing Law and Jurisdiction

This Agreement shall be governed interpreted and construed in accordance with the laws in force in india and is subject to the exclusive jurisdiction of the courts at Bettiah, Bihar, India.  In the event of any dispute arising out of the interpretation of these Terms.  The Terms shall be construed and interpreted in accordance with ‘Pawan Enterprises’ understanding thereof, and any ambiguity in the interpretation of these Terms shall not be construed against “Pawan Enterprises”.

Any and all disputes under this Agreement shall be referred to a sole Arbitrator, who shall be mutually appointed by the parties.  However, if the Parties are unable to mutually appoint an arbitrator, such arbitrator shall be appointed by the competent court in Bettiah having appropriate jurisdiction as per the Arbitration and Conciliation Act, 1996 (as amended from time to time (Arbitration Act”).  The venue of the arbitration shall be Bettiah.  The proceedings of the arbitration shall be in Hindi or English.   The parties hereby agree that the arbitrator’s award shall be binding on the parties.  The arbitration proceedings shall be governed by the Arbitration Act.  All cost of such arbitration shall be borne equally between the parties.
